The Samsung Galaxy S III will never make it to the U.S.if Apple has anything to say about it. It has filed a motion in California district court to add Samsung’s latest flagship smartphone to its request for a preliminary injunction against the Galaxy Nexus. A ruling in its favour could lead to an import ban on the Galaxy S III.
The original preliminary injunction motion lists four patents. In its latest filing, Apple is limiting its request to two patents, “the ‘604 [unified search, i.e., Siri] and ‘647 [data tapping] patents, because it is clear that infringement can be shown with respect to these patents based on the current record.” It could add the other later after it completes its own investigation into these.
Samsung’s response is that the amended filing comes too late in the process and suggests that a new preliminary injunction motion should be filed: “If Apple wishes to seek an injunction against the Galaxy S III, the Court should require Apple to file a new motion and allow the parties to develop a full factual record on all four factors. Accordingly, the Court should reject Apple’s motion to amend its current notice of motion for a preliminary injunction.”
Earlier this week, Apple filed a complaint against HTC with the ITC alleging that 29 devices, including HTC’s new HTC One devices, infringed one of its patents. It asked for an import ban on all these devices.
