Last week, TELUS sued Rogers over claims that it operated “Canada’s most reliable network.” The move came after TELUS launched its new HSPA network earlier in the month and asked Rogers to drop claims that it had the fastest and most reliable network in Canada. Today, a judge granted TELUS a temporary injunction that may force Rogers to pull down its advertisements.
In court, Rogers agreed that its claim to the fastest network was no longer valid and agreed to drop it from its ads. But Rogers still felt that it had the most reliable network and the case proceeded.
In his ruling today, Justice J. Christopher Grauer sided with TELUS that “the technological advantage that allowed Rogers to represent that it has Canada’s most reliable network has disappeared.” As a result, the ads were found to be “misleading.”
Rogers has already filed an appeal against the decision. In the meantime, the two companies will meet in court again on Friday to discuss the timing of the ads’ removal.
