Another lawsuit in the long simmering feud between Apple Computer and Apple Corps has been resolved, in favour or Apple Computer. The latest lawsuit had been filed by Apple Corps (the record label owned by the ex-Beatles) that the iTunes Music Store breached terms of a 1991 settlement on how the two companies could use their shared brand name. Specifically, the 1991 agreement states that Apple Computer cannot enter the music business. Apple Corps was seeking damages and that Apple Computer stop using its name and logo on the iTunes Music Store. “I find no breach of the trademark agreement has been demonstrated," said Judge Edward Mann in his ruling.
In the end, the judge sided with Apple Computer whose lawyers argued that the iTunes Music Store is a data transmission tool.
Apple Corps has indicated that it plans to appeal the decision.
